Mission Statement

OwnerAide believes that the most valuable asset of any service business is its good will. The Mission of the OwnerAide MyHomeProNetwork™ is to connect real estate professionals and consumers with quality real estate related service providers within their community through a business to business (“B2B”) digital marketing platform providing for business promotional and educational activities that encourage and build the local economy, create jobs locally, and enhance the quality of life in the community by fostering goodwill among the community’s residents and businesses in a curated network of trusted relationships. The goal is to provide real estate professionals and their clients with a value-added resource before, during and long after their initial engagement in a real estate related transaction.

OwnerAide

OwnerAide is an internet based B2B digital marketing platform populated with networks of real estate service professionals, including real estate agents and brokers, mortgage lenders, financial, insurance and real estate title companies, lawyers, contractors, servicemen, materialmen, and others possessing skills, talents, capabilities, aptitudes, proficiencies and abilities in the building and property trades, and of related products for real property sales, acquisition, financing, improvement, repair, maintenance, management and other real property related services and needs. For convenience, these professionals are referred to “Home Pros”. This digital marketing platform is accessible at www.myhomepronetwork.com and at many other privately branded websites or electronic portals or media through which OwnerAide licenses these services under the trademark, MyHomeProNetwork™ (each a “Licensee”).

MyHomeProNetwork™ is a community policed, business networking website established to facilitate commercial relations among curated Home Pros. OwnerAide is not a real estate brokerage, property owner or property manager and is neither affiliated with, nor an agent for, any real estate brokerage, owners or managers. OwnerAide is not a contractor or provider of services or materials, and is neither affiliated with nor an agent for any contractors, servicemen, materialmen or others engaged in the building and property trades and related products, or in any of the various “real estate settlement services” as that term is defined under the Real Estate Settlement Procedures Act, 12 U.S.C. 2607 (“RESPA”). OwnerAide is not and will not be a party to any contracts or agreements entered into between Licensees and Home Pros.

This Terms of Use and Services Agreement sets out the legally binding terms of a user’s use of this website, and by using this website you accept and agree to be bound by the terms of this Terms of Use and Services Agreement.

Eligibility of Users

This website and the services provided are available only to persons of legal age and competency to contract in the state in which the real property related services are rendered or the products or materials are supplied. By accessing or using this website, the users represent and warrant to OwnerAide, an OwnerAide Licensee or other OwnerAide contractor, servant, agent or employee, and to each other that they are legally competent to engage in the activities and relationships occasioned by such use. To the extent that such use is made by or on behalf of a corporation, partnership, Limited Liability Company or other legally fictional entity, the users represent and warrant to OwnerAide, its Licensees, contractors, servants, agents and employees, and to each other that they possess the agency and legal authority necessary to bind such entity.

Site User’s Code of Conduct

Users of this website agree that they shall not use this website to:

  1. Post false or misleading information concerning their business or property, or otherwise engage in fraud or deceptive practices;
  2. Make any arrangement or agreement that they do not intend to honor;
  3. Violate any law or regulation;
  4. Infringe upon the rights of others;
  5. Invade the privacy of others;
  6. Use this website to broadcast or disseminate information about others;
  7. Use this website to make or distribute unsolicited communications. Inclusion in an OwnerAide related network, including, without limitation, a Private Branded Network (as hereinafter defined) shall be deemed a solicitation for communications;
  8. Use this website to harass or improperly trouble any other user;
  9. Register more than one OwnerAide account except through a licensed, Private Branded Network (as hereafter defined) with the consent and participation of the Licensee;
  10. Contact any other user of this website to arrange a service or the sale of a product in violation of this Terms of Use and Services Agreement, or for any other reason or purpose contrary to, or inconsistent with, this Terms of Use and Services Agreement, or otherwise in a manner designed to evade and infringe upon the rights and interests of OwnerAide under this Terms of Use and Services Agreement;
  11. Post or publish any content that is obscene or pornographic or otherwise vulgar and offensive;
  12. Post or publish any content that is false or contains misrepresentations.
  13. Illegally discriminate against or wrongfully promote harm to any person;
  14. Engage in or Promote illegal or harmful conduct;
  15. Tamper with or interfere with the operations of this website or infringe upon OwnerAide intellectual property rights;
  16. Engage in practices that simulate the appearance or function of the OwnerAide website or the MyHomeProNetwork™ trade name or trademark;
  17. Participate in, either directly or indirectly, networks that have the purposes of soliciting exclusive marketing arrangements, bribes or kickbacks or of creating a pyramid scheme or similar fraudulent, unfair or deceptive practice;
  18. Encourage or assist any other person in doing any of the foregoing.

Functionality of this Website

This website may be used by Licensees and curated Home Pros for business development networking opportunities by access to, and use or sponsorship of, MyHomeProNetwork™ content including: e-guides, e-mail templates, blog posts, info-graphics, phone scripts, social media posts and shareable content and other related copyrighted MyHomeProNetwork™ B2B products (the “Lead Generation Content”), as well as through the publication of curator approved advertisements, materials, or B2B information promoting Home Pro capabilities and services (the “Sponsor Content”) in order to facilitate communication with, and engagement by, between and among the Licensees, their clients or other business relationships, and the Home Pros.

A user may view the promotional and educational information or materials, as well as the Lead Generation Content as a visitor to this website or to a Private Branded Network (as hereafter defined) website. Because these websites are intended only to facilitate business and client development, OwnerAide does not control the content of any Licensee or Home Pro generated or created business promotional or educational materials or business profiles. OwnerAide does not warrant the services or materials obtained through the use of this website or the Private Branded Network websites, and thus does not make any representations or warranties with regard to the Licensees, the Home Pros, any of their personal, professional or commercial publications or advertisements, websites, or business profiles, promotional or educational materials, or any other content or media not created and published by OwnerAide.

Private Branded Networks

OwnerAide offers a unique digital marketing opportunity to real estate professionals to have a non-exclusive, non-transferable, limited license to privately brand the MyHomeProNetwork ™ digital marketing platform for the use of the Licensee’s clients and business relationships within the Licensee’s on-line or e-business portal or electronic medium (a “Private Branded Network”). Through the Private Branded Network, Licensees are able to create a curated network of trusted business relationships in the name of the Licensee under the MyHomeProNetwork™ trademark. A Licensee may then build upon these business relationships by sharing Lead Generation Content and other Home Pro created or sponsored promotional and educational content, thereby creating a value added source of repeat and referral business that results in the ultimate enhancement of a Licensee’s or Home Pro’s business goodwill and revenue.

License and Network Population Management

In order for a real estate professional to obtain a non-exclusive, non-transferable, limited MyHomeProNetwork ™ license for a Private Branded Network, the real estate professional must become a Licensee pursuant to an OwnerAide MyHomeProNetwork™ License Agreement upon such terms and conditions as OwnerAide may offer from time to time. Such license is granted for, and shall exist only during, the term of the OwnerAide MyHomeProNetwork™ License Agreement or any renewal or extension thereof, subject to termination as here or therein provided. The license is limited and shall only entitle the Licensee to privately brand the MyHomeProNetwork™ digital marketing platform for networking purposes in the conduct of the Licensee’s real estate services business. The license is nonexclusive and OwnerAide reserves the unrestricted right to offer similar licenses to other Licensees. The license is non-transferable without the express written consent of OwnerAide. Except for the grant of this non-exclusive, limited license, OwnerAide reserves to itself, its successors and assigns, all of its intellectual property rights, including, without limitation, technology, patents, copyrights, trademarks, service marks, graphics and logos associated with the OwnerAide digital marketing platform and Lead Generation Content, and the Licensee shall have no rights or powers with respect thereto, but may be enjoined from the exercise thereof without regard to whether or not OwnerAide may otherwise have an adequate remedy at law, it being agreed that such intellectual property rights are unique.

In exchange and consideration for the use of the OwnerAide digital marketing platform pursuant to MyHomeProNetwork™ License Agreement, the Licensee grants to OwnerAide, without charge, royalty, fee or commission, the exclusive right and authority to solicit, in consultation with the Licensee, to profile, in consultation with the Licensee or Home Pro (see Profile Listings, infra), and to manage for profit in OwnerAide’s sole discretion, the network of Home Pros curated to populate the Licensee’s Private Branded Network (the “Grant of Authority”). The Grant of Authority is coupled with an interest. The Grant of Authority includes access, including link and internet connectivity, to the Licensee’s MyHomeProNetwork™ Private Branded Network, including digital space for Sponsor Content and B2B placements, and the capture and sharing of (subject to the OwnerAide Privacy Policy, infra.) full contact, social and engagement information concerning the Licensee, the Home Pros and all users of a Private Branded Network’s Lead Generation Content or Sponsor Content.

Profile Listings

Pursuant to the MyHomeProNetwork™ License Agreement, upon request, OwnerAide may create a business or professional profile of a Licensee or a Home Pro for inclusion on a Licensee’s Private Branded Network. The profile will be created on basis of answers to questions about the Licensee or Home Pro to be profiled, including: (i) personal identification information; (ii) information concerning the Licensee’s or Home Pro’s businesses, products, skills, capabilities and professional licensing, pricing and other applicable considerations appropriate to the Licensee’s or Home Pro’s business or professional “Profile;” all as the nature of the Licensee’s or the Home Pro’s business may require for full, accurate and complete disclosure and marketing integrity. Photos and videos that may depict the talents, skills and capabilities of a Licensee or Home Pro may be displayed or otherwise made accessible to a website user in connection with service or product solicitations.

Identification Information, Non-Identification Information and Account Information, as those terms are defined in the OwnerAide Privacy Policy may also be required and obtained in connection with a Licensee’s or Home Pro’s profile. A Licensee’s or Home Pro’s profile may further establish the conditions that must be met in order for website user to contact or respond to the Licensee or Home Pro.

All Home Pro and Licensee profiles may be available to the general public via the MyHomeProNetwork™ or a Private Branded Network website. Use of these websites may facilitate business contacts between users by making the Profile information and various other tools available to website users so as to enable the users to make informed decisions. A user is solely responsible for the decisions that are made.

OwnerAide does not endorse, recommend or sponsor any Licensee or Home Pro, and does not attempt to confirm a website user’s identity or the veracity or accuracy of any Profile. An OwnerAide or Private Branded Network website user is solely responsible for determining the identity and suitability of others that are contacted through the MyHomeProNetwork™ website or a Private Branded Network website.

A user of this website or a Private Branded Network website is advised seek and obtain such additional information, including information from other sources, as may be appropriate to the decision making process. OwnerAide shall not be liable to a user as a consequence of the user’s reliance solely upon the information obtained from this website without further investigation.OwnerAide reserves the unilateral right and authority to remove, discontinue or disable access to any profile posted on this website at any time, and for any reason, and without prior notice.

Taxes

To the extent that OwnerAide is obliged by law to file or report tax information to state or federal revenue services concerning payments to or by users of this website, OwnerAide shall collect such information from users as may from time to time be necessary in order to meet such filing or reporting requirements, including IRS Forms W-9. Users of this website understand and agree that they are solely responsible for determining their applicable tax reporting requirements.

Licensee License, Pricing and Terms

Limited License: In order for a real estate brokerage to obtain a non-exclusive, non-transferable, limited license for a Private Branded Network, the brokerage must become a Licensee upon such terms and conditions as OwnerAide may offer to the brokerage under the terms of an OwnerAide License Agreement privately negotiated between OwnerAide and the brokerage. Such license is granted for and shall exist only during the term of the OwnerAide License Agreement or any renewal or extension thereof, subject to termination as here or therein provided. The license is limited and shall only entitle the Licensee to privately brand the OwnerAide program for networking purposes in the conduct of the Licensee’s real estate brokerage business. The license is non-exclusive and OwnerAide reserves the unrestricted right to offer similar licenses to other real estate brokerages. The license is non-transferable without the express written consent of OwnerAide. Except for the grant of this non-exclusive, limited license, OwnerAide reserves to itself, its successors and assigns, all of its intellectual property rights, including, without limitation, technology, patents, copyrights, trademarks, service marks, graphics and logos associated with the OwnerAide software program, and the Licensee shall have no rights or powers with respect thereto, but may be enjoined from the exercise thereof without regard to whether or not OwnerAide may otherwise have an adequate remedy at law, it being agreed that such intellectual property rights are unique.

Pricing and Payment: OwnerAide earns compensation from the Licensee in exchange for the OwnerAide License and the creation of a Private Branded Network under the MyHomeProNetwork™ trade name and trademark. OwnerAide may also received compensation for the solicitation and management of Home Pros who become members of the Private Branded Networks. License fees and Home Pro network membership fees are priced in accordance with the terms of the OwnerAide License Agreement as privately negotiated between OwnerAide and the Licensees. The prices and policies as established pursuant to the OwnerAide License Agreement and as they may be modified from time to time, are deemed a part of this Agreement. Under the OwnerAide License Agreement, and as may be individually negotiated with a Home Pro concerning membership on a Licensee’s Private Branded Network, OwnerAide may bill the Licensee or the Home Pro through an online account (the “Billing Account”) for the use of the OwnerAide program or the Home Pro Private Branded Network membership fees. Except as may otherwise be established under the OwnerAide License Agreement, or as may be individually negotiated with the Home Pro, the Licensee and the Home Pro agree to pay all fees and agreed compensation to OwnerAide through the means of the Billing Account. The Licensee and Home Pro authorize OwnerAide to charge the Licensee’s or Home Pro’s chosen payment provider (“Payment Method”) for the fees and other compensation. The Licensee and Home Pro agree to make payment using that selected Payment Method. OwnerAide may correct any billing errors or mistakes that it makes even if it has already requested or received payment. The Licensee and Home Pro agree to OwnerAide storing the Licensee’s or Home Pro’s payment information. Licensee and Home Pro agree that the Billing Account and Payment Method shall apply to any other services or products that OwnerAide may offer and the Licensee or Home Pro may accept for a fee. Among the additional services that OwnerAide may provide to the Licensee under the OwnerAide License Agreement is the solicitation, profiling, and management of Home Pros for inclusion and participation in a Private Branded Network for a fee. If solicited, established and managed under agreement with the Licensee, Home Pro membership fee payments shall be processed and managed though the Licensee Billing Account and Payment Method. The methods of payment as established between the Licensee or Home Pro will be subject to Licensee’s or Home Pro’s Payment Method as may be determined by agreements between the Licensee or Home Pro and its financial institution, credit card issuer or other provider of Licensee’s or Home Pro’s chosen Payment Method. If the Licensee or Home Pro initiates a chargeback or otherwise reverses a payment made through the Payment Method, OwnerAide may in its discretion terminate the OwnerAide License Agreement or Home Pro Private Branded Network membership immediately. If OwnerAide successfully disputes the reversal, and the reversed funds are returned to OwnerAide, the Licensee or Home Pro is not entitled to a refund or to have its OwnerAide License or Home Pro Private Branded Network membership reinstated.

Licensees and Home Pros authorize OwnerAide to charge the Licensee or the Home Pro for any sales or similar taxes that may be imposed on OwnerAide licensing fees or Home Pro Private Branded Network membership fees and related compensation.

Renewal: Home Pro Private Branded Network memberships shall be automatically renewed at the established membership fee unless cancelled upon written notice from the Home Pro or the Licensee to OwnerAide. Unless otherwise paid through the Licensee’s Billing Account and Payment Method, the Home Pro authorizes OwnerAide to charge the Home Pro’s Payment Method at the beginning of any renewal or extension of the Home Pro’s membership on a Private Branded Network. Cancellation within a term of membership by a Home Pro shall not entitle the Home Pro to any refund of prepaid membership fees. Cancellation of a Home Pro’s membership in Private Branded Network by a Licensee shall entitle the Home Pro to a pro-rated refund of the membership fee unless the termination is for cause, including bad service or product reviews. The allowed Home Pro partial refund will be charged to the Licensee Billing Account. An allowed Home Pro’s Private Branded Network membership fee refund may be credited to the Home Pro’s Payment Method.

The OwnerAide License Agreement shall be renewable in accordance with its terms. The Licensee agrees that the Licensee’s Billing Account and Payment Method will be subject to renewal automatically, commensurate with the renewal of the OwnerAide License Agreement. If the Licensee does not wish the Billing Account and Payment Method to renew automatically, or if the Licensee wants to change its Billing Account or Payment Method, the Licensee must contact support@owneraide.com. By entering into an OwnerAide License Agreement, the Licensee authorizes OwnerAide to charge the Licensee’s Payment Method initially and again at the beginning of any renewal or extension of the OwnerAide License Agreement, as well as promptly upon entitlement to compensation for the rendition of services or otherwise in connection with Home Pro membership on a Licensee’s Private Branded Network. The Licensee also authorizes OwnerAide to charge the Licensee for any sales or similar taxes that may be imposed on OwnerAide licensing fees or Home Pro Private Branded Network membership fees and related compensation. If OwnerAide does not receive payment from the Payment Method provider, (i) the Licensee shall pay all amounts due on the Billing Account upon demand; and (ii) OwnerAide may terminate or suspend the OwnerAide License Agreement and continue to attempt to charge the Payment Method provider until payment is received. The Licensee’s use of the Private Branded Network and the MyHomeProNetwork™ trade name and trademark reaffirms that OwnerAide is authorized to charge the Payment Method and otherwise establishes the Licensee’s unconditional liability for the License fees.

Current Information: Licensees and Home Pros must provide current, complete and accurate information for the Billing Account. The Licensee and Home Pro must promptly update all information to keep the Billing Account current, complete and accurate (such as a change in billing address, card number or expiration date), and must promptly notify OwnerAide if the Payment Method is canceled or if the Licensee or Home Pro becomes aware of a potential breach of security (such as an unauthorized disclosure or use of the Licensee name or password). If the Licensee or Home Pro fails to provide OwnerAide any of the foregoing information, the Licensee and Home Pro each agrees to be unconditionally responsible and liable for fees accrued under the Billing Account. In addition, the Licensee and Home Pro authorize OwnerAide to obtain updated or replacement expiration dates and card numbers for such credit or debit cards as provided by the credit or debit card issuer.

Termination: The Licensee may terminate the OwnerAide License Agreement only in accordance with the terms of the OwnerAide License Agreement. The Licensee shall be liable for all accrued and unpaid OwnerAide license fees and all earned but unpaid Home Pro Branded Private Network membership fees notwithstanding a termination. Licensee shall also be solely liable to any Home Pro for any claimed refund of unearned Private Branded Network membership fees, and shall hold OwnerAide harmless therefrom and indemnify OwnerAide of liability therefor. OwnerAide may terminate the OwnerAide License Agreement only in accordance with the terms of the OwnerAide License Agreement. If OwnerAide terminates the OwnerAide License Agreement because of a breach of this Agreement or of the OwnerAide License Agreement, the Licensee will not be entitled to any refund of license fees or Home Pro Private Branded Network membership fees, but shall be liable for any accrued and unpaid Home Pro membership fees.

Use Licenses

Subject to the user’s compliance with this Terms of Use and Services Agreement, the user is granted limited license to only use this website for its intended purposes. This limited license is non-exclusive and non-transferable.

Except as expressly permitted regarding an OwnerAide License for a Private Branded Network, no right or license is given to copy, distribute, license, sell, transfer, transmit, broadcast or otherwise exploit the content of this website, or to otherwise infringe upon or violate OwnerAide copyrights and property rights in any way.

No right or license is given with regard to the rights or properties of other users of this website, and any implied license with regard to the rights and properties of others is expressly disclaimed.

A user of this website grants to OwnerAide a non-exclusive, royalty-free license to: (i) use, copy, adapt, modify, reproduce in conjunction with the purposes of this website; (ii) to display, broadcast, transmit and otherwise publish and disseminate, via this website; and (iii) otherwise exploit for profit in a manner consistent with the purposes of this website, all content posted or listed on this website by the user (the “User Content”).

The user represents and warrants to OwnerAide that: (i) the user is solely responsible for all User Content; (ii) the user has all legal right, title, and/or interest, including licenses, privileges and authorities, in or to the User Content that are necessary to grant to OwnerAide the rights in such User Content contemplated by this Terms of Use and Services Agreement; and (iii) use of the User Content will not infringe upon or violate a third party’s property rights, or rights of publicity or privacy, or result in the violation of any law or regulation. The user shall indemnify and hold harmless OwnerAide from any claims or liabilities attributable to the content or posting of the User Content.

OwnerAide may provide links to electronic resources and other websites, including user websites. Owner aide is not responsible for the availability or integrity of such resources or websites. OwnerAide is not responsible for any content, products or services available from such websites or resources. OwnerAide disclaims any representations or warranties regarding the content, product or services found at such websites or resources. A user assumes all risks associated with the use of such resources or websites.

Limitations of Liability

OwnerAide is not an insurer or guarantor of the financial ability or creditworthiness of any users of this site, or of any of the services or materials obtained by the use hereof, or through the use of a Private Branded Network all of which are provided without warranty or representation of merchantability, fitness for a particular purpose, quality, or title on the part of OwnerAide. All such representations or warranties, including those as may otherwise be implied by law, are expressly disclaimed by OwnerAide.

OwnerAide does not investigate the background of users of this website or of Private Branded Networks. Users engage the services or purchase the products at their sole risk, without warranty of any kind, either expressed or implied on the part of OwnerAide. No information obtained from OwnerAide through this website or a Private Branded Network will create any warranty not otherwise expressly made under this Terms of Use and Services Agreement.

OwnerAide disclaims any and all liability attributable to the fault or misconduct of any contracting party engaged through this website or a Private Branded Network. All users of this website agree that such use is at the user’s own risk, and that the user’s sole recourse for economic or personal loss or injury shall be to the other contracting party only.

OwnerAide shall not be liable to a user of this website or a Private Branded Website for any consequential or incidental damages, including damages for personal injury or emotional distress, or for special or exemplary damages, arising out of or in connection with any communications, relationships, interactions, arrangements, contracts or agreements between or among users of this website, or their products or services, whether based upon contract, tort or other theory of liability, in law or equity. In any event, should a claim or action against OwnerAide arise out of or pertain to a Project, OwnerAide’s total liability for such claim or action shall not exceed the Total Cost of the Project.

Any claim or cause of action against OwnerAide must be commenced within one year of the date such claim or cause of action first accrued, or it shall be time barred. The validity, construction, and enforcement of this Terms of Use and Services Agreement, and all claims arising hereunder shall be governed by the laws of the State of Connecticut (but not its conflicts of law provisions). All claims or actions arising directly or indirectly hereunder may only be litigated in Courts having situs within the State of Connecticut. Users of this website consent and voluntarily submit to the jurisdiction of the State of Connecticut, hereby appointing the Connecticut Secretary of State as their statutory agent for service of process.

Users of this website expressly waive trial by jury in any court and in any suit, action or proceeding on any matter arising in connection with or in any way related to this Terms of Use and Services Agreement and this website.

Mediation and Arbitration

Mediation is not mandatory and may be declined by either party. If any dispute, controversy or claim arising in connection with this Terms of Use and Services Agreement or the service provided through this website, (including disputes regarding the validity or enforceability of this Terms of Use and Services Agreement), either party may, upon written notice to the other party, request that the matter be mediated. Such mediation will be conducted by a neutral facilitator acceptable to both parties. Both parties will exert their best efforts to discuss with each other in good faith their respective positions in an attempt to finally resolve such dispute or controversy.

All such discussions, however, will not be admissible in any subsequent litigation against the disclosing party. Except as agreed by both parties, the mediator will keep confidential all information disclosed during the negotiations. The mediator may not act as a witness for either party in any subsequent arbitration between the parties.

The mediation proceedings will conclude within sixty days from receipt of the written notice unless extended or terminated sooner by mutual consent. The parties may also agree at any time to terminate or waive ongoing mediation. Each party will be responsible for its own expenses. The fees and expenses of the mediator, if any, will be borne equally by the parties.

If any dispute, controversy, or claim arises in connection with this Terms of Use and Services Agreement or the service provided through this website (including disputes regarding the validity or enforceability of this Terms of Use and Services Agreement) and cannot be resolved by mediation, then upon the agreement of both parties such dispute, controversy or claim may be settled by binding arbitration pursuant to the rules of the American Arbitration Association’s arbitration program and that the arbitrator(s) may award reasonable attorney’s fees to the prevailing party in such proceedings. The mediation and arbitration hearings will take place in Hartford, Connecticut. Arbitration shall be binding and final.

Reportage and Notices

A user may submit feedback, comments or suggestions concerning this website by emailing OwnerAide support@owneraide.com. Upon receipt, such feedback, comments and suggestions, and all rights thereto or interests therein, shall become the property of OwnerAide.

A user may report improper conduct or misbehavior by other users of this website by contacting OwnerAide at support@owneraide.com. The reportage of such improper conduct or misbehavior does not obligate OwnerAide to take any action with regard thereto, or cause OwnerAide to incur any liability associated therewith. Users are encouraged to report illegal conduct to proper authorities.

All notices or other communications from OwnerAide to users will be in writing and delivered to users electronically at the user’s registered address. Notices may also be posted on this website. Electronic deliveries are presumed received on the date sent.

Services Availability

The services provided under this Agreement are provided as they may exist and be available from time to time, and OwnerAide has no other obligations, except as expressly stated in this Agreement. For so long as OwnerAide continues to offer the services under this Agreement, OwnerAide may seek to update, improve and expand the services, may modify, replace, suspend or discontinue services partially or entirely, or change or modify prices prospectively and may withhold, remove or discard any content with or without notice, if deemed to be contrary to the purposes of this Agreement or the intended uses of the services.

Modification of Terms

OwnerAide reserves the sole and unilateral right to modify this Terms of Use and Services Agreement, this website and its contents at any time and without prior notice. By continuing to access or use this website after OwnerAide has posted a modification, the user is indicating that he or she agrees to be bound by the modified terms. If the user does not want to agree to changes to this Agreement, the user can terminate the Agreement as herein provided.

Privacy Policy

The OwnerAide Privacy Policy, as may be modified from time to time, is a part of this OwnerAide Terms of Use and Services Agreement.

Entire Agreement

Except as may be varied by the terms of a MyHomeProNetwork™ License Agreement, this Terms of Use and Services Agreement constitute the entire and exclusive agreement between OwnerAide and users of this website and OwnerAide services. The failure of OwnerAide to enforce any provision of this Terms of Use and Services Agreement shall not constitute a waiver of the right to enforce that provision in the future. If for any reason an arbitrator or a court of competent jurisdiction finds any provision of this Terms of Use and Services Agreement invalid or unenforceable, the other provisions of this Terms of Use and Services Agreement will remain in full force and effect.

Statement of Purpose

This Privacy Policy states OwnerAide® and Licensees of the MyHomeProNetwork™ Private Branded Networks (as those terms are defined in the OwnerAide® Terms of Use and Services Agreement) policies and procedures regarding the collection, use and disclosure of personal information that OwnerAide® or a Licensee receives from users of this or a Private Branded Network website. OwnerAide® and its Licensees may modify this Privacy Policy from time to time. This Privacy Policy is a part of the OwnerAide® Terms of Use and Services Agreement.

Personal Identification Information

OwnerAide® and its Licensees provide an internet based, digital marketing platform where real estate professionals and contractors, servicemen, materialmen, attorneys, financial and title services and others possessing skills, talents, capabilities, aptitudes, proficiencies and abilities in real estate sales, acquisition, financing and building and property trades, and related products (the “Home Pro”) can be connected to facilitate networking and business development, often in the service of homebuyers and home sellers.

When a user registers with OwnerAide or a MyHomeProNetwork™ Licensee, the user is required to provide personal identification and contact information (“Identification Information”) such as the user’s:

  • a. name,
  • b. postal address,
  • c. phone,
  • d. email address,
  • e. date of birth,
  • f. Website,
  • g. federal tax id number (SSN or EID)
  • h. Geo-location

The OwnerAide® and Licensee registration process may also require Identification Information concerning a business, including Identification Information regarding the business owners, officers or operators or authorized agents. Business Identification Information may include the business website and website URL as well as business license numbers and geographical operating areas. OwnerAide® and the Licensees do not require a user’s social security (“SSN”) or employer ID number (“EIN”) solely in connection with the use of this website or a Private Branded Network.

OwnerAide® and the Licensee may register a user or may Profile a Home Pro (see Terms of Use) on a user’s or Home Pro’s behalf using publicly available information about the user or Home Pro. Publicly available information may include any material published on the Internet by the Home Pro, the user or the user’s employer.

In addition, registration may require billing and payment information for the user (“Account Information”) such as:

  • a. credit card number,
  • b. bank account number,
  • c. bank wire or electronic fund transfer information,
  • d. billing or payment postal address,
  • e. Taxpayer ID number, if required by local, state or federal taxing authorities.

Account Information is processed through a third party payment service provider such as Braintree (Paypal) or Quicken (WePay) and secured using industry-standard encryption technology and procedural safeguards intended to comply with state and federal regulations concerning personal and financial privacy.

Identification Information and Account Information also may be obtained when a user registers through a third party social or business network account (a “TPN”) such a Facebook® or LinkedIn®, if this third party account is linked to the user’s OwnerAide® or a Licensee account upon registration. A user registering on OwnerAide® and a Licensee’s MyHomeProNetwork™ account through a TPN affirms the truth and accuracy of the Identification Information and Account Information contained on the TPN, and authorizes OwnerAide® and the Licensee to access, use and store that Identification Information and Account Information in connection with the user’s or Home Pro’s OwnerAide® and MyHomeProNetwork™ profiles, products and services on the OwnerAide® and MyHomeProNetwork™ website.

Based on risk analysis, and to the extent reasonable and practicable, OwnerAide® or the Licensee will ensure that OwnerAide® or the Licensee reasonably knows the true identity of its customers by using risk-based procedures to verify and document the accuracy of the Identification Information. The OwnerAide® and the Licensee require documents to verify customer identity when appropriate documents are available. Appropriate documents include government issued identification for individuals and government filed organizational documents for businesses, such as Articles of Incorporation, or business licenses. The OwnerAide® or the Licensee may also use non-documentary means of identification, such as obtaining references from reliable sources.

Additional information may be provided through a user’s or Home Pro’s posting of a profile on the OwnerAide® or the Licensee’s website or Private Branded Network, or from the user’s TPN listings or profiles (Non-Identification Information). OwnerAide® and the Licensee may combine Identification Information and Account Information with Non-Identification Information. The collected Identification Information, Account Information and Non-Identification Information are referred to as the “Personal Information.”

OwnerAide uses Personal Information to, among other things:

  • a. provide products and services, including “Lead Generation Content” and “Sponsor Content” (as those terms are defined in the OwnerAide® Terms of Use and Services Agreement),
  • b. to market or make available to users the products, services, business development and educational materials of Licensees and Home Pros,
  • b. to complete transactions
  • c. to render bills,
  • d. to make payments,
  • e. to communicate,
  • f. and to administer programs,
  • g. assure compliance with OwnerAide’s Customer Identification Program (“CIP”).

The user authorizes OwnerAide® and Licensee to use and to share some or all of the Personal Information as needed for those purposes, as well as for other activities or uses that may be necessary or appropriate to the proper performance or fulfillment of those purposes.

OwnerAide and Licensee will not collect Account Information in an unsecure or unsolicited communication.

Other Data Collection

OwnerAide® automatically records data (“Log Data”) that it receives electronically when someone visits this website or a Private Branded Network. This Log Data may include details of the visit and other information, including the visitor’s computer's internet protocol ("IP") address, browser type and browser version. OwnerAide® also uses transferred data files or “Cookies” and electronic images or “Web Beacons” to collect data. OwnerAide® may use the Cookies to connect a user’s website activities with other user Personal Information that OwnerAide® obtains. OwnerAide® may use the Web Beacons on the OwnerAide® website and Private Branded Networks to track views of Profiles, Lead Generation Content and Sponsor Content (together the “Content”). OwnerAide® may then use the Web Beacons to track visits to websites associated with the Profiles or Content.

This data is used to monitor and analyze the use of this website, the Private Branded Networks and the Content for digital marketing purposes, as well as to facilitate the use and administration of this website. Third parties engaged by OwnerAide® in the conduct of its digital marketing platform may use Cookies to deliver advertisements, business development or educational materials to users of the OwnerAide® or Private Branded Network websites.

Information Sharing and Disclosure

If OwnerAide® and a Licensee employ third party, independent contractors in connection with the management, operation or administration of their websites, such third parties may have limited access to Personal Information for such purposes or otherwise as a consequence of their employment activities. These third parties are subject to non-disclosure agreements by which they are obligated not to use or disclose such Personal Information for any purpose other than as maybe necessary to the performance of their employment on behalf of OwnerAide® and the Licensee.

For business development purposes, including communications regarding products and services, a user may receive promotional e-mails from OwnerAide® or a Licensee, and we may share Personal Information with trusted business affiliates who are subject to the OwnerAide® Privacy Policies. A user may opt to prohibit such sharing by contacting our support unit at support@OwnerAide®.com.

OwnerAide® takes its legal obligations and responsibilities seriously. Subject to applicable financial privacy laws, OwnerAide® may cooperate with government and law enforcement officials or with private parties acting under color of the law to enforce or comply with the law. OwnerAide® may disclose Personal Information as it determines to be necessary or appropriate to properly respond to claims or legal process, or to protect the safety, property and rights of others.

OwnerAide® and a Licensee may disclose Personal Information in the event of a sale of all or part of its assets, or the merger, acquisition, reorganization or bankruptcy. In doing so, OwnerAide® will comply with applicable financial privacy laws to protect the Account Information of OwnerAide® users.

The OwnerAide® and Licensee websites may contain links to other websites. An OwnerAide® or a Private Branded Network user may choose to visit another website through a link or banner advertisement. OwnerAide® does not endorse any other business or its website, or make any representations or warranties regarding the websites or products of other parties. OwnerAide® does not control the websites of other parties and such websites may not satisfy our Terms of Use or our Privacy Policy. Users that visit other websites though a link or banner ad on the OwnerAide® or a Licensee website do so at their own risk. OwnerAide® recommends that users study the privacy policies of other websites before visiting them. OwnerAide® does not exercise control over third party websites, including those of Licensees.

Changing Personal Information

All registered users of OwnerAide® may review, update, edit, or correct their Personal Information at any time by contacting support@OwnerAide®.com.

Registered users may cancel their OwnerAide® registration at any time. Cancellation will not terminate any then pending transactions or existing obligations or liabilities, and Personal Information will be retained until such time as OwnerAide® is fully satisfied, in its sole discretion, that all pending transactions, obligations and liabilities of the user have been concluded or satisfied. Users may opt out of Cookie and Web Beacon tracking and analysis.
